Key points
This summary doesn't replace the Terms below. If the two differ, the full Terms control.
- Caliber Classes is a booking tool. Independent instructors list and teach the lessons. Caliber doesn't teach, supervise or take part in any lesson.
- Caliber doesn't check instructors. It doesn't verify credentials, licenses, insurance, backgrounds or eligibility to possess firearms. Choose your instructor yourself.
- You must be 18 or older. Each participant requests their own lesson and agrees to the booking disclaimer each time.
- You pay your instructor directly, for example by Cash App, Zelle, Venmo or at the lesson. Caliber doesn't process, hold or refund lesson payments. Don't pay until your instructor confirms.
- The trainer and the student carry full responsibility for the lesson and for any payment between them. Caliber is a booking tool only and supplies no waiver. Your instructor or the range may ask you to sign their own.
- Cancellations and refunds are between you and your instructor, under the cancellation policy your instructor shows.
- Messages are checked automatically by simple keyword rules. No artificial intelligence is used.
- Florida law applies. You keep any rights your own state's law gives you that can't be waived. There's no arbitration.
1. About these Terms
1.1 Who you're agreeing with. These Terms of Service ("Terms") are an agreement between you and [OPERATOR], a Florida limited liability company ("Caliber," "we," "us").
- Mailing address: [MAILING ADDRESS]
- Email: support@norbrookmedia.com
These Terms cover Caliber Classes, the part of the Caliber app where you can find and message independent instructors and request in-person firearm-safety lessons and classes with them. Section 18 also describes Caliber Pro.
1.2 How you accept. You accept these Terms by turning on "I agree" when you sign in to Caliber Classes, and again each time you tap Request lesson or Request a seat. If you don't agree, please don't use Caliber Classes.
1.3 Other documents that are part of these Terms.
- Privacy Policy ([PRIVACY POLICY URL]). It explains what we collect, why, and how long we keep it.
- Booking disclaimer. Each time you request a lesson or a seat, you read and agree to the booking disclaimer first. It says that Caliber is a booking tool only; that you're responsible for reviewing and researching your instructor before the lesson; that your instructor alone is responsible for the lesson, its safety and any payment between you; and that your instructor or the range may ask you to sign their own waiver. Any waiver is between you and your instructor or the range. Caliber isn't a party to it.
- Instructor Agreement. If you teach on Caliber, it's part of these Terms. On instructor matters, it controls if it conflicts with these Terms.
- Apple's license. Your license to use the Caliber app comes from Apple's Licensed Application End User License Agreement. For Caliber Classes, these Terms control if the two conflict. Apple isn't a party to these Terms and isn't responsible for Caliber Classes, lessons or payments.
1.4 Electronic records and signatures.
- You agree that we may give you these Terms, the booking disclaimer and notices electronically, in the app or by email.
- You can accept electronically. Your electronic acceptance is your signature.
- You can ask us for a copy of anything you've accepted or signed at support@norbrookmedia.com.
- If you don't want to deal with us electronically, please don't use Caliber Classes.
2. Who can use Caliber Classes
- Adults only. You must be 18 or older to sign in to Caliber Classes, send messages, or request or take part in a lesson or class.
- When you sign in, the app checks your age using the age range your Apple device shares, where that's available. Otherwise, it asks you to confirm that you're 18 or older.
- If the app store reports that you're under 18, you can't use Caliber Classes.
- Accurate and lawful. You must be in the United States, give accurate information, and have only one Caliber Classes account. You may not use Caliber Classes if federal or state law prohibits you from possessing firearms or ammunition.
- One person per lesson. Each person who takes part needs their own request. No one under 18 may take part, and there are no guests or walk-ins. Your instructor or the range may ask to see a photo ID.
- Where it's available. Caliber Classes is available for in-person lessons in the states listed at [OPEN STATES URL]. We're opening state by state, starting with Florida. A lesson can be listed and requested only in a state we've opened.
3. Your account
3.1 Signing in.
- You sign in to Caliber Classes with Sign in with Apple. Keep your Apple Account secure.
- You're responsible for what happens under your Caliber Classes account.
- If you think someone else is using it, tell us right away at support@norbrookmedia.com.
3.2 Deleting your account. You can delete your Caliber Classes account at any time in the app: Profile › Caliber Classes › Delete Caliber Classes account. When you do:
- Your upcoming requests and lessons are cancelled. The other person in each one is told it was cancelled. Caliber doesn't handle lesson payments, so any refund of money paid directly to an instructor is between the student and the instructor.
- Your account details are removed.
- Your profile, photos and payment details are deleted.
- Your conversations are closed for everyone.
- Your name and email are removed from your account.
- Apple sign-in is revoked where possible.
- Your reviews. Your review text and your name are removed from your reviews. Your star ratings stay in instructors' averages without your name.
We keep some records after deletion, because the other person or the law may need them:
- past requests and lessons;
- records that you agreed to the booking disclaimer, and any signed waiver records from before it;
- messages;
- reports and their outcomes.
The Privacy Policy says how long we keep each of these. Deleting your Caliber Classes account doesn't affect the data the core Caliber app keeps on your device and in your own iCloud, or a Caliber Instructor subscription, which you cancel with Apple.
4. What Caliber does, and what your instructor does
4.1 Caliber is a booking tool, not a party to your lesson.
- Caliber Classes is an online booking tool and directory. Independent instructors list in-person lessons and classes, students request them, and instructors confirm or decline the requests.
- Caliber isn't the instructor, the range or a firearms dealer. It doesn't teach, supervise or control any lesson or class, and it isn't a party to any agreement or payment between a student and an instructor.
- Caliber doesn't sell, rent or transfer firearms, ammunition or any other regulated item.
4.2 The trainer and the student are responsible for the lesson.
- Instructors are independent businesses, not Caliber's employees or agents.
- Your instructor decides what to teach, how, where and when, and sets the price, the payment methods and the cancellation policy.
- Your instructor provides the lesson and is responsible for it: its content and quality, and safety during it. They're also responsible for holding the licenses, certifications and insurance that the law or the range requires.
- You're responsible for your own choices: choosing an instructor, following safety instructions, and any payment you make.
- In plain English: the trainer and the student carry full responsibility for the lesson and for any payment between them. Responsibility for injury is between them and is governed by the law (section 1.3). Caliber isn't a party to the lesson.
4.3 Caliber doesn't check instructors.
CALIBER DOESN'T CHECK INSTRUCTORS. CALIBER DOESN'T VERIFY ANY INSTRUCTOR'S IDENTITY, CREDENTIALS, LICENSES, CERTIFICATIONS, INSURANCE, EXPERIENCE, CRIMINAL HISTORY OR ELIGIBILITY TO POSSESS FIREARMS, AND IT DOESN'T SUPERVISE OR MONITOR LESSONS. PROFILES, LISTINGS, CREDENTIALS, PRICES AND PAYMENT DETAILS ARE WRITTEN BY INSTRUCTORS. CALIBER MAY REMOVE CONTENT OR ACCOUNTS, BUT IT DOESN'T PROMISE TO MONITOR LISTINGS OR TO ACT ON ANY REPORT. YOU DECIDE WHETHER TO BOOK AN INSTRUCTOR, AND YOU DON'T RELY ON CALIBER FOR THAT DECISION.
- When they start and every year, instructors confirm that they're 21 or older (18 or older for active-duty service members and veterans), that the law doesn't prohibit them from possessing firearms, and that the credentials they list are genuine. Caliber doesn't check those statements.
- Credentials shown on a profile read "Listed by the instructor · not checked by Caliber."
- Credential names belong to the organizations that issue them. Caliber isn't affiliated with or endorsed by those organizations.
4.4 State permit and license courses.
- A listing that presents itself as a state permit or license course (for example, a Florida Concealed Weapon License class) shows the instructor's credential as the instructor entered it, with a link to the state agency.
- Caliber doesn't confirm that any class meets a state's permit or license training requirement. Check with the state agency before you rely on a class for a permit or license application.
4.5 In person, at a real place.
- Lessons and classes on Caliber are taught in person, at the place named in the listing. Caliber doesn't offer online or live-video classes.
- The range or venue has its own rules. It may ask you to sign its own waiver or pay its own fees directly.
5. Requesting and paying
5.1 How a request works.
- You request a private lesson or a seat in a class in the app. Your request shows as Pending and holds that time or seat.
- Your instructor confirms it (it then shows as Confirmed) or declines it.
- A request your instructor doesn't answer expires 48 hours after you sent it, or when the lesson starts, if that's sooner.
- A request isn't a booking until your instructor confirms it.
5.2 Paying your instructor.
- Caliber doesn't process, receive, hold, transmit or refund any payment for a lesson or class.
- You pay your instructor directly, using the payment methods your instructor lists (for example Cash App, Zelle or Venmo) or at the lesson. The app shows those details once you've sent a request.
- Any payment arrangement is only between you and your instructor. The payment app's or bank's own terms apply to a payment you make with it.
5.3 Pay safely.
- Don't pay until your instructor confirms your request.
- Zelle and other app payments may not be reversible, and may not have the protections a credit-card payment has.
- Never pay with gift cards, a wire transfer, Western Union or MoneyGram, and report anyone who asks you to.
- If your instructor's payment details change after you sent your request, the app tells you. Check with your instructor before you pay.
- Caliber isn't responsible for any payment you make, or for getting it back.
5.4 What the price covers.
- Your instructor sets the price for each lesson or class.
- The price covers the instruction and anything your instructor provides for use during the lesson.
- Caliber doesn't sell ammunition, firearm rentals, range admission or lane time, gear or merchandise.
- If a range charges students directly (for example, a lane fee), instructors must say so in the listing. You pay any such fee to the range.
5.5 Check before you request.
- Before you tap Request lesson or Request a seat, the app shows a summary:
- the lesson and the instructor;
- the date, time and time zone;
- the place;
- the participant;
- the price;
- the instructor's cancellation policy.
- If anything is wrong, go back and fix it before you send the request.
5.6 Taxes. Your instructor is the seller of the lesson and is responsible for any tax on it. Caliber doesn't collect tax on lessons.
5.7 Free lessons. Free lessons and classes work the same way. You still agree to the booking disclaimer.
6. What Caliber charges
- Students pay Caliber nothing. Caliber takes no part of what you pay your instructor.
- Instructors pay Caliber a subscription to list lessons and take requests. It's sold and billed by Apple, and the Instructor Agreement describes it.
7. Cancellations, refunds and problems
7.1 The instructor's cancellation policy.
- Each instructor shows one of three cancellation policies. It describes what the instructor says they'll refund if you cancel:
- Flexible: Full refund up to 24 hours before. 50% refund 2–24 hours before. No refund within 2 hours.
- Standard: Full refund up to 48 hours before. 50% refund 12–48 hours before. No refund within 12 hours.
- Strict: Full refund up to 7 days before. 50% refund 48 hours–7 days before. No refund within 48 hours.
- The policy shown when you send your request is saved with it, even if the instructor changes it later.
7.2 How to cancel. Either of you can cancel a request or a confirmed lesson in the app before it starts. Cancelling tells the other person. It doesn't move any money.
7.3 Refunds are between you and your instructor.
- Caliber can't issue, force or guarantee a refund, because Caliber never receives your payment.
- If you're owed money under the instructor's policy, or because your instructor cancelled, ask your instructor. You may also have rights through your payment app or bank, under their rules.
7.4 Report a problem.
- Use Report a problem on the lesson within 72 hours after its scheduled end if your instructor didn't show up, the lesson was materially different from the listing or unsafe, or someone asked you to pay in an unsafe way.
- We'll look at what happened. We may remove a listing or suspend an account. We can't refund a payment we never received.
7.5 If you miss the lesson. If you don't show up, or arrive too late to take part safely, it counts as a cancellation at the start time under your instructor's policy.
8. Certificates
- Caliber doesn't issue certificates.
- Any certificate of completion comes from your instructor. Caliber doesn't confirm that it meets any state's requirements. Check with the state agency.
9. Rules for using Caliber Classes
9.1 What you agree not to do. You agree not to:
- sell, buy, trade or transfer firearms, ammunition, firearm parts or any other regulated item through Caliber. This includes using Caliber to arrange an FFL transfer or a private sale with someone you met here;
- ask for or offer payment by gift card, wire transfer, Western Union, MoneyGram or any other method meant to get around a payment app's protections, or give false payment details;
- request or list a lesson you don't intend to take or give;
- request for, or bring, anyone under 18, a guest, or anyone who hasn't requested their own lesson;
- harass, threaten, bully or discriminate against anyone, or send hateful or sexual content. We have zero tolerance for this;
- give false information, pretend to be someone else, or misrepresent your credentials or experience;
- post anything unlawful, or anything that explains how to illegally make or modify a firearm;
- share another person's private information without their permission;
- scrape, overload or interfere with Caliber, or get around its security, limits or safety checks;
- use Caliber Classes for anything unlawful or unsafe.
9.2 No firearm records.
- Caliber Classes doesn't ask for information about the firearms you own and has no place to enter it, and Caliber keeps no list or record of firearms or firearm owners.
- Please don't put serial numbers or lists of firearms in messages, listings or reviews.
- The armory in the core Caliber app stays on your device and in your own iCloud.
9.3 Arranging future lessons directly.
- You and an instructor you met on Caliber may arrange future lessons directly.
- A lesson you arrange outside Caliber isn't a Caliber request. The booking disclaimer, messaging, reporting and review terms in these Terms don't cover it, and Caliber has no part in it.
9.4 If you break these rules. Section 16 explains what we may do.
10. Messages, safety checks, reporting and blocking
10.1 Who can message whom.
- Students can message any listed instructor.
- An instructor can start a conversation only with someone who has requested a lesson with them.
- To limit spam, each account can start only a limited number of new conversations in a day.
10.2 Automatic keyword checks.
- Every message you send through Caliber Classes is checked automatically when it's sent. The checks are rule-based keyword filters: simple word and phrase matching, not artificial intelligence.
- The filters look for wording about buying, selling or transferring firearms, and about unsafe payment methods such as gift cards and wire transfers.
- A message that matches is still delivered. The sender sees a reminder, and the message goes to our review queue, where a person at Caliber may read it.
- The checks run on Caliber's own systems. We don't send your messages to any outside moderation or AI service.
- Messages, profile text and reviews that match filters for threats, slurs or sexual content are held, and not delivered or shown, until a person at Caliber reviews them.
- By accepting these Terms, you agree to these checks on every message you send and receive through Caliber Classes.
10.3 Reporting.
- You can report a person, a message, a profile, a photo, a lesson or a review in the app.
- Each report goes to Caliber for review. We may dismiss it, hide or remove content, suspend an account, or take other action. We keep a record of each report and its outcome.
10.4 Blocking. You can block anyone you're messaging. A block stops new conversations and new messages between you, in both directions. You can unblock later.
10.5 Emergencies. Caliber isn't an emergency service, and it doesn't watch conversations as they happen. In an emergency, call 911.
11. Reviews
- Who can review.
- After a lesson or class you requested through Caliber, and your instructor confirmed, has taken place, you can rate it and write a review about your own experience.
- There's one review per lesson or class.
- How reviews appear.
- Reviews show your first name and last initial, and the lesson or class you took.
- The instructor can post one public reply.
- Star ratings appear once an instructor has at least 3 reviews.
- Ownership. You keep ownership of your review. You give Caliber a non-exclusive, royalty-free license to host, display and share it in connection with Caliber.
- Honest reviews are protected.
- Caliber won't penalize you, charge you or threaten legal action against you for an honest review.
- Instructors may not ask you to sign anything that limits your reviews, or offer you anything in exchange for a positive review or for changing or removing a negative one.
- Don't post a fake review, a review of a lesson you didn't take, or a review you were paid or rewarded to write.
- When we remove a review. We remove or hide a review only if:
- it contains another person's personal information or likeness;
- it's defamatory, harassing, abusive, obscene, vulgar or sexually explicit;
- it's discriminatory or inappropriate about race, gender, sexuality, ethnicity or another intrinsic characteristic;
- it's unrelated to the lesson or class;
- it's clearly false or misleading;
- it contains trade secrets or confidential business information; or
- we reasonably believe it's fake, for example because it was written by the instructor or someone acting for them.
We apply these rules the same way to every review, whatever its rating. We never remove or hide a review because it's negative.
- Reporting a review. You can report a review in the app.
12. Your content and copyright complaints
12.1 Your content.
- You own the photos, profile text, messages and reviews you post.
- You give Caliber a non-exclusive, royalty-free, worldwide license to host, store, display, copy and share them, only to run Caliber Classes. That includes showing public profiles, listings and reviews on Caliber's public web pages.
- The license ends when you delete the content or your account, except for:
- copies other people already received, such as messages; and
- records we keep as described in the Privacy Policy.
- Post only content you have the right to share.
12.2 Copyright complaints. If you believe content on Caliber infringes your copyright, send a written notice to our designated agent:
[DMCA AGENT NAME]
[OPERATOR]
[DMCA AGENT ADDRESS]
[DMCA AGENT PHONE]
[DMCA AGENT EMAIL]
Under 17 U.S.C. § 512(c)(3), your notice must include:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- the copyrighted work you believe is infringed;
- the material you believe is infringing, with enough information for us to find it;
- your contact information;
- a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you're authorized to act for the copyright owner.
12.3 Counter-notices.
- If we remove your content after a notice and you believe it was removed by mistake or misidentification, you can send our agent a counter-notice under 17 U.S.C. § 512(g)(3). It must include:
- your signature;
- a description of the removed material and where it appeared;
- a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
- your name, address and phone number; a statement that you consent to the jurisdiction of the federal district court for the district where your address is; and a statement that you'll accept service of legal papers from the person who sent the notice.
- Unless the person who complained tells us they've filed a court action, we restore the material 10 to 14 business days after we receive a valid counter-notice.
12.4 Repeat infringers. In appropriate circumstances, we close the accounts of people who repeatedly infringe others' copyrights.
13. Disclaimers
DISCLAIMERS
TO THE EXTENT THE LAW ALLOWS, CALIBER CLASSES IS PROVIDED "AS IS" AND "AS AVAILABLE." CALIBER DOESN'T VOUCH FOR ANY INSTRUCTOR, LESSON, CLASS, RANGE OR PAYMENT, ISN'T A PARTY TO ANY AGREEMENT OR PAYMENT BETWEEN STUDENTS AND INSTRUCTORS, AND DOESN'T PROMISE THAT CALIBER CLASSES WILL ALWAYS BE AVAILABLE OR FREE OF ERRORS.
FIREARMS TRAINING HAS REAL RISKS, INCLUDING SERIOUS INJURY OR DEATH. CALIBER IS A BOOKING TOOL ONLY. IT DOESN'T TEACH, SUPERVISE OR CONTROL ANY LESSON OR CLASS, AND YOUR INSTRUCTOR ALONE IS RESPONSIBLE FOR IT. YOU'RE RESPONSIBLE FOR REVIEWING AND RESEARCHING YOUR INSTRUCTOR BEFORE THE LESSON. NOTHING ON CALIBER IS LEGAL ADVICE.
NOTHING IN THESE TERMS LIMITS OR WAIVES ANY RIGHT OR REMEDY YOU HAVE UNDER A CONSUMER-PROTECTION LAW OR ANY OTHER LAW THAT CAN'T BE WAIVED OR LIMITED BY CONTRACT, INCLUDING THE FLORIDA DECEPTIVE AND UNFAIR TRADE PRACTICES ACT AND THE CONSUMER-PROTECTION LAWS OF THE STATE WHERE YOU LIVE.
14. Limitation of liability
LIMITATION OF LIABILITY
IN THIS SECTION, "CALIBER" INCLUDES ITS AFFILIATES AND THEIR OWNERS, MEMBERS, EMPLOYEES AND CONTRACTORS. TO THE EXTENT THE LAW ALLOWS:
(A) CALIBER ISN'T LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS; AND
(B) CALIBER'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO CALIBER CLASSES IS LIMITED TO THE GREATER OF (1) THE AMOUNTS YOU PAID CALIBER FOR CALIBER CLASSES IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (2) $100.
THESE LIMITS DON'T APPLY TO: (A) MONEY WE OWE YOU; (B) CLAIMS UNDER A CONSUMER-PROTECTION LAW OR ANY OTHER STATUTE; (C) HARM CAUSED BY OUR GROSS NEGLIGENCE, FRAUD OR WILLFUL MISCONDUCT; (D) ANYTHING ELSE THE LAW DOESN'T ALLOW US TO LIMIT; OR (E) CLAIMS FOR BODILY INJURY, ILLNESS, DEATH OR PROPERTY DAMAGE CONNECTED WITH A LESSON OR CLASS, WHICH ARE GOVERNED BY APPLICABLE LAW.
15. Your responsibility to Caliber
- If someone else brings a claim against Caliber because you broke these Terms, broke the law, or posted content through Caliber, you'll cover Caliber's reasonable losses and costs from that claim.
- This doesn't cover any part of a claim caused by Caliber's own negligence or misconduct.
- An instructor's responsibility for their lessons is set out in the Instructor Agreement.
16. Suspension and ending
- You can leave at any time. You can stop using Caliber Classes and delete your account whenever you like (section 3.2).
- What we may do. We may remove content, hide listings or photos, limit features, or suspend or close an account:
- if someone breaks these Terms;
- to protect people's safety or prevent fraud; or
- if the law requires it.
Where appropriate, we'll tell you why. If you think we made a mistake, contact support@norbrookmedia.com.
- Upcoming lessons. If an account is suspended or closed, its upcoming requests and lessons may be cancelled, and the other person is told. Any refund of money paid directly to an instructor is between the student and the instructor (section 7.3).
- Your records. A suspended account can still delete itself.
- What continues. Sections that by their nature should continue after an account ends do continue. These include sections 3.2, 7, 12 through 15, 19 and 20.
17. Changes to these Terms
- Versions. We may update these Terms. Each version has a version date, and every earlier version is at [PRIOR VERSIONS URL].
- Going forward only. Changes apply only going forward.
- Notice. For a material change, we'll tell you in the app, and by email if we have your address, at least 30 days before it takes effect. We'll give less notice only where the law or safety requires it.
- Accepting a new version.
- When a new version takes effect, we'll ask you to accept it in the app.
- Until you do, you can't send new requests or messages.
- If you don't accept it, you can stop using Caliber Classes and delete your account.
- We'll never treat simply continuing to use the app as accepting a new version.
- Requests you've already sent keep the price and cancellation policy shown when you sent them.
- Earlier claims. A change never applies to a claim or dispute that arose before the change took effect.
18. Caliber Pro
- What it is. Caliber Pro is an optional upgrade for the core Caliber app, offered by [APP PUBLISHER], which publishes the Caliber app. It's sold and billed by Apple through the App Store, and Apple's terms govern the purchase. You don't need Caliber Pro to use Caliber Classes.
- Renewal.
- Monthly and yearly plans renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- If you start a free trial, it becomes a paid plan unless you cancel at least 24 hours before the trial ends.
- Lifetime is a one-time purchase that doesn't renew.
- Cancelling. You can cancel the same way you subscribed: in Caliber, go to Profile and tap Manage Subscription, or open Settings › [your name] › Subscriptions on your iPhone.
- Reminder. Yearly subscribers get an in-app reminder before each renewal.
- Refunds. Refunds for Caliber Pro are handled by Apple at reportaproblem.apple.com. Caliber can't issue them.
- Never locked. Safety lessons and your data backups are never locked behind Pro.
19. Disputes and governing law
(a) Talk to us first.
- Before filing a claim, send a written description of the problem and the outcome you want to support@norbrookmedia.com or to our mailing address. Then give us 30 days to try to resolve it. We'll do the same before filing a claim against you.
- This doesn't stop either of us from asking a court for urgent relief.
- If a legal deadline would pass during those 30 days, you may file before the 30 days end.
(b) Small claims. Either of us may use small-claims court where the claim qualifies.
(c) Where claims go.
- Other claims you bring against Caliber must be filed in the state courts located in Hillsborough County, Florida, or in the U.S. District Court for the Middle District of Florida, Tampa Division, unless the law where you live gives you the right to bring the claim there.
- This doesn't apply to a claim for injury, illness, death or property damage connected with a lesson or class. That claim may be brought in any court that has jurisdiction.
- If Caliber brings a claim against you, it will do so in the courts where you live, or in another court that has jurisdiction over you.
(d) Governing law.
- Florida law governs these Terms, without regard to conflict-of-law rules. You keep any protection of the law where you live that can't be waived by contract.
- Claims for injury, illness, death or property damage connected with a lesson are governed by the law of the state where the lesson takes place.
(e) No arbitration. Nothing in these Terms requires arbitration.
(f) Time limits. These Terms don't shorten any time limit the law gives you to bring a claim.
20. General
- Entire agreement. These Terms, together with the documents in section 1.3, are the whole agreement between you and Caliber about Caliber Classes.
- If part can't be enforced. That part is limited only as much as needed, and the rest still applies.
- Transfer.
- You may not transfer your account or these Terms.
- Caliber may transfer these Terms to an affiliate, or to a business that takes over Caliber Classes (for example, a separate company formed to run Caliber). We'll tell you if that happens. Your rights under these Terms don't change because of the transfer.
- No waiver. If we don't enforce a term right away, we can still enforce it later.
- Events outside anyone's control. Neither of us is responsible for a delay or failure caused by events outside our reasonable control, such as outages or natural disasters. This never excuses money we owe you.
- Attorneys' fees. Nothing in these Terms gives only one side a right to recover attorneys' fees from the other.
- Relationship. These Terms don't make you and Caliber partners, employer and employee, or agents of each other.
- Notices. We send notices in the app or to the email on your account. Please send legal notices to us at support@norbrookmedia.com and to our mailing address.
- Headings. Headings are for convenience only.
